Today, most companies operating in logistics, IT, manufacturing and other fields in Azerbaijan cooperate with foreign partners. However, tax benefits are not used properly - the main reason is the failure to submit DTA (Double Taxation Avoidance) forms on time.
What is a DTA Form?
DTA is an international tax agreement between two countries that prevents double taxation of income. Currently, Azerbaijan has such agreements with more than 50 countries.
If DTA forms are submitted correctly:
Tax on foreign payments is zero or minimal
Tax risks are reduced
Your company's reputation is protected
What Happens If a DTA Form Is Not Submitted?
The state budget is taxed at 10%, according to the agreement it should be 0
The foreign partner is taxed at 10–15%, since there is no residency certificate
The risk of tax audits and fines increases
The image of an unreliable partner is created
Forms not submitted on time can be returned
If DTA-03 has not been submitted and the tax has been paid, it can be returned within 3 years. For this:
DTA-05 form is submitted
A certificate of residency of the foreign party is submitted
A contract, payment documents and other evidence are prepared
Most Commonly Used DTA Form Types
Form Purpose
DTA-01 To avoid tax when receiving income from abroad
DTA-02 To withdraw tax paid abroad in Azerbaijan
DTA-03 To avoid tax when making a payment to a foreign company
DTA-05 To recover previously paid tax by mistake
DTA-06 To submit the form with an official letter
Real Examples
Logistics Company “BakuCargo” – During payment with a partner in Romania, DTA-03 was not submitted, 10,000 AZN of 100,000 AZN was withheld as tax. Two years later, the company discovered this error, submitted DTA-03 and DTA-05 and refunded the money.
IT License – If DTA-03 is not presented when purchasing software online from Germany, 3,000 AZN will be taxed from the 30,000 AZN payment. When presented, the tax is 0%.
Remember: Working without a DTA form is a denial of profit!
